{"id":91,"date":"2022-05-31T08:49:01","date_gmt":"2022-05-31T06:49:01","guid":{"rendered":"https:\/\/labsis.geo3bcn.csic.es\/?page_id=91"},"modified":"2024-09-16T12:54:32","modified_gmt":"2024-09-16T10:54:32","slug":"terms-of-use","status":"publish","type":"page","link":"https:\/\/labsis.geo3bcn.csic.es\/?page_id=91","title":{"rendered":"Terms of use"},"content":{"rendered":"\n<p><strong>Introduction<\/strong><\/p>\n\n\n\n<p>LabSis is registered as a Scientific-Technical Service of the CSIC and as such, the use of its services is linked to the payment of fees set annually and which vary depending on the type of entity that makes use of it.<\/p>\n\n\n\n<p>The services directly related to the use of seismic instrumentation offered by LabSis are:<\/p>\n\n\n\n<p>\u2022 Subsurface seismic monitoring equipment (high-resolution nodes)<\/p>\n\n\n\n<p>\u2022 Broad-band seismic stations<\/p>\n\n\n\n<p>\u2022 Short-period seismic stations<\/p>\n\n\n\n<p>The technical characteristics and the number of existing instruments of each type are detailed on the LabSis website ( http:\/\/labsis.geo3bcn.csic.es )<\/p>\n\n\n\n<p><strong>Application for the service<\/strong><\/p>\n\n\n\n<p>LabSis offers its services and infrastructures on a competitive basis to researchers from all academic or research institutions active in the field of Earth Sciences, both national and international, although in this case it is recommended to establish joint projects with Spanish partners. The submission of applications with the participation of industry or for commercial purposes is also&nbsp;possible.<\/p>\n\n\n\n<p>Applications must be submitted using the form available at&nbsp;(<a href=\"https:\/\/saco.csic.es\/s\/YGEiNrFJQTXaRpp\">https:\/\/saco.csic.es\/s\/YGEiNrFJQTXaRpp<\/a>), at least 3 months in advance of the date of delivery of the material and must be linked to an approved research project. In exceptional cases, the supply of short-term instruments is possible, provided that it is justified by the nature of the study to be carried out (e.g. a seismic or volcanic crisis).<\/p>\n\n\n\n<p>Applications must clearly indicate the number of instruments of each class required and the expected period of use.&nbsp;<\/p>\n\n\n\n<p>LabSis must be informed as soon as possible in the event of cancellation of the field experiment or that part of the requested instrumentation will not be used. If changes to the approved schedule (i.e. the date of collection and return) are unavoidable, updated information must be sent to LabSis as quickly as possible.<\/p>\n\n\n\n<p>A non-official waiting list will be managed by LabSis with the expressions of interest pending approval of the corresponding research projects.<\/p>\n\n\n\n<p><strong>Prioritisation of applications<\/strong><\/p>\n\n\n\n<p>Applications will be prioritised based on the following criteria:<\/p>\n\n\n\n<p>1) Research projects managed by academic institutions with competitive public funding.<\/p>\n\n\n\n<p>2) Research projects and contracts funded by the industrial sector.<\/p>\n\n\n\n<p>3) Commercial uses<\/p>\n\n\n\n<p>If necessary, priority will be given (in this order) to projects managed by the&nbsp;GEO3BCN-CSIC, projects managed by other CSIC centres, projects linked to other OPIs, AGEs and Spanish universities and, lastly, projects with commercial purposes.<\/p>\n\n\n\n<p><strong>General Rules of Use<\/strong><\/p>\n\n\n\n<p>The applicant must contact LabSis to verify the schedule and specifications of the planned experiment at least 2 months before the start of the project.<\/p>\n\n\n\n<p>LABSIS will provide a pro-forma invoice, which should be accepted by the applicant.<\/p>\n\n\n\n<p>Instruments will be transferred after the signing of the contract of use or the materialization of the internal charge.&nbsp;LabSis will verify the operation of the instruments before handing them over.<\/p>\n\n\n\n<p>The users will confirm in writing the reception in good condition of the&nbsp;requested&nbsp;instrumentation and the commitment to take the utmost care and attention in its transport, deployment and maintenance.<\/p>\n\n\n\n<p>The delivery of the material to the users is carried out at&nbsp;GEO3BCN. LabSis will provide users with a complete list of the instrumentation to be delivered. LabSis technical staff will advise users on the operation, transport and particularities of use of the instruments and, if necessary, provide the necessary training for the appropriate use of the instrumentation.<\/p>\n\n\n\n<p>The costs derived from the transport of the material to its destination and, if applicable, the payment of customs duties, will be borne by the applicants.<\/p>\n\n\n\n<p>The costs related to the acquisition of the consumables necessary for the use of the instrumentation (batteries, protection and insulation materials, etc.) will be borne by the users.<\/p>\n\n\n\n<p>LabSis aims to ensure high availability of the seismic instrumentation it manages. However, in unforeseeable circumstances (such as theft, technical defects or similar), the availability of the equipment may be restricted.&nbsp;<\/p>\n\n\n\n<p><strong>Handling of the instruments<\/strong><\/p>\n\n\n\n<p>The user is responsible for the instruments during the loan period. All instruments must be returned in the condition in which they were loaned, i.e. physically clean, with the data storage empty, and with the original software installed.<\/p>\n\n\n\n<p>Upon return of the instruments, a list of the malfunctions observed in the instruments, as well as any damage they may have suffered, must be provided to LabSis staff.<\/p>\n\n\n\n<p><strong>Assumption of responsibility<\/strong><\/p>\n\n\n\n<p>Users must be able to demonstrate their training in the handling of the requested instrumentation, as well as the availability of sufficient personnel for the installation and maintenance of&nbsp;the instruments. The choice of the most suitable instrumentation for each project is the responsibility of the users.<\/p>\n\n\n\n<p>The use of the instruments is carried out at the users&#8217; own risk, who will be responsible for any damage to third parties that may arise from their use.<\/p>\n\n\n\n<p>Breakdowns or losses of the equipment must be assumed by the corresponding project, so it is recommended to take out insurance to cover these contingencies. In certain exceptional circumstances, LabSis may decide to assume all or part of these costs when it is considered that they are not the result of negligent actions on the part of the users.<\/p>\n\n\n\n<p>In the event of theft or disappearance of all or part of the&nbsp;instrumentation provided, the&nbsp;user is obliged to appear before the police to report the incident. This report must be sent to LabSis as soon as possible.<\/p>\n\n\n\n<p><strong>Data transfer<\/strong><\/p>\n\n\n\n<p>The original data in miniseed format, the associated metadata and a report of the experiment must be delivered to LabSis within three months after the end of the experiment and will be stored on the LabSis servers.<\/p>\n\n\n\n<p>At the request of the user, an embargo period for the distribution and use of the data of up to 4 years will be established. From that moment, the data will be freely available under a Creative Commons license. In the case of projects with commercial uses, specific conditions for the use of the data may be agreed. specific conditions for the use of the data.<\/p>\n\n\n\n<p><strong>Publication of results<\/strong><\/p>\n\n\n\n<p>A DOI will be obtained for each set of data acquired using LabSis instrumentation, which will be mandatory in publications that make use of said data.<\/p>\n\n\n\n<p>Publications related to experiments with LabSis instruments must include an express mention of LabSis in the acknowledgments, indicating the reference assigned to the project.<\/p>\n\n\n\n<p>LabSis is not responsible for the veracity and correctness of publications derived from data obtained from its instrumentation.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Introducci\u00f3n<\/strong><\/p>\n\n\n\n<p>LabSis est\u00e1 registrado como un Servicio Cient\u00edfico-T\u00e9cnico del CSIC y como tal, el uso de sus prestaciones est\u00e1 vinculado al pago de unas tarifas fijadas anualmente y que var\u00edan en funci\u00f3n del tipo de entidad que realiza el uso.<\/p>\n\n\n\n<p>Las prestaciones directamente relacionadas con el uso de la instrumentaci\u00f3n s\u00edsmica ofrecidas por LabSis son:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Equipos de monitorizaci\u00f3n s\u00edsmica del subsuelo (nodos de alta resoluci\u00f3n)<\/li>\n\n\n\n<li>Estaciones s\u00edsmicas de periodo ancho (broad-band)<\/li>\n\n\n\n<li>Estaciones s\u00edsmicas de corto periodo<\/li>\n<\/ul>\n\n\n\n<p>Las caracter\u00edsticas t\u00e9cnicas y el n\u00famero de instrumentos existentes de cada tipo se detallan en la p\u00e1gina web de LabSis (&nbsp;<a href=\"http:\/\/labsis.geo3bcn.csic.es\/\">http:\/\/labsis.geo3bcn.csic.es<\/a>&nbsp;)&nbsp;<\/p>\n\n\n\n<p><strong>Solicitud de la prestaci\u00f3n<\/strong><\/p>\n\n\n\n<p>LabSis ofrece sus servicios e infraestructuras en r\u00e9gimen de acceso competitivo a los investigadores de todas las instituciones acad\u00e9micas o de investigaci\u00f3n con actividad en el campo de las Ciencias de la Tierra, tanto nacionales como internacionales, si bien en este caso se recomienda establecer proyectos conjuntos con socios espa\u00f1oles. Se contempla as\u00ed mismo la presentaci\u00f3n de solicitudes con participaci\u00f3n de la industria o con fines comerciales.&nbsp;<\/p>\n\n\n\n<p>Las solicitudes se deber\u00e1n presentar utilizando el formulario disponible en&nbsp;(<a href=\"https:\/\/saco.csic.es\/s\/YGEiNrFJQTXaRpp\">https:\/\/saco.csic.es\/s\/YGEiNrFJQTXaRpp<\/a>),&nbsp;con una antelaci\u00f3n m\u00ednima de 3 meses a la fecha de entrega del material y deber\u00e1n ir vinculadas a un proyecto de investigaci\u00f3n aprobado. En casos excepcionales es posible el suministro de instrumentos a corto plazo, siempre y&nbsp;&nbsp;cuando est\u00e9 justificado por la naturaleza del estudio a realizar (p.e. una crisis s\u00edsmica o volc\u00e1nica).<\/p>\n\n\n\n<p>Las solicitudes deben indicar claramente el n\u00famero de instrumentos de cada clase requeridos y el periodo previsto de uso.&nbsp;<\/p>\n\n\n\n<p>LabSis debe ser informado tan pronto como sea posible en el caso de cancelaci\u00f3n de la campa\u00f1a de campo o de que parte de la instrumentaci\u00f3n solicitada no vaya a ser utilizada. Si resulta inevitable efectuar cambios en el calendario aprobado (es decir, la fecha de recogida y retorno) la informaci\u00f3n actualizada debe hacerse llegar al LabSis con la m\u00e1xima celeridad.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Desde el LabSis se gestionar\u00e1 una lista de espera, de car\u00e1cter no oficial, con las expresiones de inter\u00e9s pendientes de la aprobaci\u00f3n de los correspondientes &nbsp;proyectos de investigaci\u00f3n&nbsp;<\/p>\n\n\n\n<p><strong>Priorizaci\u00f3n de las solicitudes<\/strong><\/p>\n\n\n\n<p>La priorizaci\u00f3n de las solicitudes se realizar\u00e1 en funci\u00f3n del siguiente criterio:<\/p>\n\n\n\n<p>1)&nbsp;&nbsp;Proyectos de investigaci\u00f3n gestionados por instituciones acad\u00e9micas con financiaci\u00f3n p\u00fablica competitiva.<\/p>\n\n\n\n<p>2) Proyectos y contratos de investigaci\u00f3n con financiaci\u00f3n del sector industrial.<\/p>\n\n\n\n<p>3)&nbsp;&nbsp;Usos con fines comerciales&nbsp;<\/p>\n\n\n\n<p>En caso necesario, se priorizar\u00e1n (en este orden) los proyectos gestionados desde el GEO3BCN-CSIC, los proyectos gestionados por otros centros CSIC, los proyectos vinculados a otros OPI, AGE y universidades espa\u00f1olas y, en \u00faltimo t\u00e9rmino, los proyectos con fines comerciales.<\/p>\n\n\n\n<p><strong>Normas generales de uso<\/strong><\/p>\n\n\n\n<p>El solicitante deber\u00e1 ponerse en contacto con el LabSis para verificar el calendario y las especificaciones del experimento planeado como m\u00ednimo 2 meses antes del inicio del proyecto.&nbsp;<\/p>\n\n\n\n<p>LabSis proporcionar\u00e1 una factura proforma, que deber\u00e1 ser aceptada por el solicitante.<\/p>\n\n\n\n<p>Los instrumentos se ceder\u00e1n despu\u00e9s de la firma del contrato de uso o la materializaci\u00f3n del cargo interno. LabSis verificar\u00e1 el funcionamiento de los instrumentos antes de entregarlos.<\/p>\n\n\n\n<p>Los usuarios confirmaran por escrito la recepci\u00f3n en buenas condiciones de la instrumentaci\u00f3n requerida y el compromiso de tener el m\u00e1ximo cuidado y atenci\u00f3n en su transporte, despliegue y mantenimiento.<\/p>\n\n\n\n<p>La entrega del material a los usuarios se realiza en el GEO3BCN. LabSis proporcionar\u00e1 a los usuarios con suficiente antelaci\u00f3n la relaci\u00f3n completa de la instrumentaci\u00f3n que se va a entregar.<\/p>\n\n\n\n<p>El personal t\u00e9cnico de LabSis aconsejar\u00e1 a los usuarios sobre el funcionamiento, transporte y particularidades de uso de los instrumentos y, en caso necesario, proporcionar\u00e1 la formaci\u00f3n necesaria para el uso apropiado de la instrumentaci\u00f3n.&nbsp;<\/p>\n\n\n\n<p>Los costes derivados del transporte del material hasta su lugar de destino y, en su caso, del pago de derechos de aduana, ir\u00e1n a cuenta de los solicitantes.<\/p>\n\n\n\n<p>Los costes relacionados con la adquisici\u00f3n de los consumibles necesarios para el uso de la instrumentaci\u00f3n (bater\u00edas, materiales de protecci\u00f3n y aislamiento etc.)&nbsp;&nbsp;ir\u00e1n a cargo de los usuarios.&nbsp;<\/p>\n\n\n\n<p>LabSis tiene el objetivo de asegurar la disponibilidad de la instrumentaci\u00f3n s\u00edsmica que gestiona. Sin embargo, en circunstancias imprevisibles (tales como robos, defectos t\u00e9cnicos o similares), la disponibilidad de los equipos puede quedar restringida.&nbsp;<\/p>\n\n\n\n<p><strong>Manejo de los instrumentos&nbsp;<\/strong><\/p>\n\n\n\n<p>El usuario es responsable de los instrumentos durante el per\u00edodo de cesi\u00f3n. Todos los instrumentos tienen que ser devueltos en las condiciones en que fueron cedidos, es decir, limpios f\u00edsicamente, con el almacenamiento de datos vac\u00edo, y con software original instalado.<\/p>\n\n\n\n<p>Al regreso de los instrumentos, se debe entregar al personal de LabSis una relaci\u00f3n de los fallos de funcionamiento observados en los instrumentos, as\u00ed como de los desperfectos que hayan podido sufrir.&nbsp;<\/p>\n\n\n\n<p>En el caso particular de los nodos de alta resoluci\u00f3n el usuario debe tener en cuenta que los instrumentos contienen bater\u00edas internas de litio que est\u00e1n clasificadas como mercanc\u00edas peligrosas de clase 9. La responsabilidad de LabSis respecto al manejo de estos equipos se extingue en el momento de la entrega de los equipos al usuario o al transportista designado por \u00e9l.&nbsp;<\/p>\n\n\n\n<p><strong>Asunci\u00f3n de responsabilidad&nbsp;<\/strong><\/p>\n\n\n\n<p>Los usuarios deber\u00e1n poder demostrar su capacitaci\u00f3n para el manejo de la instrumentaci\u00f3n solicitada, as\u00ed como la disponibilidad de personal suficiente para las labores de instalaci\u00f3n y el mantenimiento de los instrumentos. La elecci\u00f3n de la instrumentaci\u00f3n id\u00f3nea para cada proyecto es responsabilidad de los usuarios.<\/p>\n\n\n\n<p>El uso de los instrumentos se realiza a cuenta y riesgo de los usuarios, que ser\u00e1n responsables de los da\u00f1os a terceros que pudieran derivarse de su uso.<\/p>\n\n\n\n<p>Las aver\u00edas o p\u00e9rdidas de los equipos deben ser asumidos por el proyecto correspondiente, por lo que se recomienda la contrataci\u00f3n de un seguro que cubra estas contingencias. En determinadas circunstancias de car\u00e1cter excepcional, LabSis podr\u00e1 decidir asumir total o parcialmente estos costes cuando se considere que no son el resultado de actuaciones negligentes por parte de los usuarios.<\/p>\n\n\n\n<p>En caso de robo o desaparici\u00f3n de todo o parte de la instrumentaci\u00f3n cedida, el usuario tiene la obligaci\u00f3n de comparecer ante la polic\u00eda para denunciar el hecho, incluyendo en ella los n\u00fameros de serie de los equipos desaparecidos. La denuncia deber\u00e1 remitirse a LabSis tan pronto como sea posible.<\/p>\n\n\n\n<p><strong>Cesi\u00f3n de datos<\/strong><\/p>\n\n\n\n<p>Los datos originales en formato miniseed, los metadatos asociados y un informe del experimento deben ser entregados al LabSis en el plazo de tres meses despu\u00e9s de la finalizaci\u00f3n del experimento y quedar\u00e1n almacenados en los servidores de LabSis.<\/p>\n\n\n\n<p>A petici\u00f3n del usuario, se establecer\u00e1 un periodo de embargo para la distribuci\u00f3n y uso de los datos de hasta 4 a\u00f1os. A partir de ese momento, los datos estar\u00e1n disponibles libremente bajo una licencia de Creative Commons. En el caso de proyectos con usos comerciales, se podr\u00e1n acordar condiciones espec\u00edficas para el uso de los datos.<\/p>\n\n\n\n<p><strong>Publicaci\u00f3n de resultados<\/strong><\/p>\n\n\n\n<p>Se tramitar\u00e1 la obtenci\u00f3n de una DOI para cada conjunto de datos adquiridos mediante la instrumentaci\u00f3n LabSis, que ser\u00e1 de obligada referencia en las publicaciones que hagan uso de dichos datos.<\/p>\n\n\n\n<p>Las publicaciones relacionadas con los experimentos con instrumentos de LabSis deber\u00e1n incluir una menci\u00f3n expresa a LabSis en los agradecimientos, indicando la referencia asignada al proyecto.&nbsp;<\/p>\n\n\n\n<p>LabSis no se responsabiliza de la veracidad y correcci\u00f3n de las publicaciones que se deriven de los datos obtenidos de su instrumentaci\u00f3n.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Introduction LabSis is registered as a Scientific-Technical Service of the CSIC and as such, the use of its services is linked to the payment of fees set annually and which vary depending on the type of entity that makes use of it.
